But that's not what counsel said at argument, right? He said at argument that there is no record in this or any other case that Gmail is sharded with pieces all over the world. What am I missing?
He's clearly saying that Microsoft isn't sharding the emails. Agree that the gmail point is confusing - he may have taken Alito to be asking the question the brief responds to re not knowing where the different shards are, & said no one is breaking emails into unlocatable pieces.
Right, no one has suggested that MSFT is sharding its e-mails. Rather, the claim is that others do, like gmail. He says that's just wrong, but he is mistaken, right? I totally understand he may have misunderstood the Q, but I want to clarify that what he said was wrong.
FWIW, I'm extremely certain that MS *is* sharding their email, albeit not necessarily internally using that term, nor necessarily braking up individual emails or even accounts of users.
