      True, but is the exact source of funding material? Especially since Steele was blind to its source? I think the disclosure, as presented in the memo, was pretty full and frank - again, they aren't proving crimes beyond a reasonable doubt, they're simply showing probable cause

      My sense is that a judge would not feel misled by DOJ saying "source was hired to look for damaging info" instead of "source was hired BY THE DNC to look for damaging info." There are lots of cases holding that a generic description is sufficient.

      Well that's not correct... Steele wasn't hired by the DNC. The DNC hired a law firm that then hired Fusion GPS who then subcontracted to Steele... I agree, if the DNC hired Steele directly I think that would have likely been material - but that's not what happened here

      To push the matter even further, I think this entire ordeal is a distraction - even if the Page warrant was wrongfully obtained (which I don't agree with), it has absolutely 0 effect on the overall Russia investigation/what Mueller is doing and CERTAINLY doesn't vindicate Trump

      FISA strikes me as a legitimate subject for scrutiny. If the gov't is doing something that is legal but that makes Americans uncomfortable, we're free to change the law. Q is whether people are troubled by the standards apart from the partisan questions.

      From a policy perspective that makes sense - but Trump and Fox are equating the Page app with being evidence of Trump's innocence, and that is frustrating to me. Also: Page is mentioned in 3 pages of the dossier, and the FISA app was at least 56 pages...

      I'll just say you won't find much support in the courts for the idea that a legally defective warrant is proof of the target's innocence, let alone that of a sort-of maybe former associate of the target.

      Oh, absolutely, I know. But the problem is that if Mueller finds evidence of SERIOUS wrongdoing, at least insofar as I can surmise, the solution against Trump will be a political one at first (impeachment) - and that will take the public forcing legislators to act

      And THAT is what I think this memo is designed, from its inception, to accomplish - spread seeds of doubt among the average public who 1) doesn't have legal familiarity 2) doesn't have an incentive to critically read memos or 3) just gets info from the media/Trump's twitter

      It's possible the memos are being read *too* critically. They both seem like blind men grasping the elephant, and shaping their descriptions at least in part around partisan goals. The most important part is that there remains a lot we don't know.

      ISTM the responsible response would be to introduce more safeguards against bad applications, e.g. forcing FISA courts to be somewhat adversarial even for "small" things like wiretap applications. It's obvious that there's no way to get to a decision about current application.

          I just hope people keep separate the "is this good policy" v. "the FBI and DOJ are clearly corrupt" or "the Russia investigation is fake news." I have no patience for the latter... FISA reform is a separate question, and I respect people's opinions on that policy issue

          Even if you throw out every single piece of evidence gleaned under that Page warrant, I suspect there is still overwhelming evidence of Campaign wrongdoing.
