I think that's at least partially because the current law (and its interpretation) is unfavorable to you. IANAL. There's plenty of cases that basically see 4A not being violated at border crossings due to expectation of privacy not being violated.
Current legal arguments afaict are more about whether that'll include things like the *contents* of your phone and such (which has been held to a higher standard in other situations).
