Seems he's making a bit of an arbitrary distinction between the Elders and Divine beings, why should they be different?

The argument rests on whether or not Jesus was citing the elohim of Psalm 82 or the elders of Israel in the Torah. If the former, as Heiser argues, then Christ is basically saying, "The Gods who the Word of God came can be called Gods. Yet I cannot be called the Son of God?"

Yes I get the argument, I just think that he tries to make a contradiction where there is none, the Elders of Israel were surely divine (angelic) beings

I dunno enough about elders of Israel to comment but you're probably right.

Also I think Heiser makes a non existent distinction between angels and "sons of God", not paying any attention to the Angelic Hierarchy
