    If the president signs an executive order declaring that immigrants are not "subject to the jurisdiction" of the United States, more than 40 million people will have a claim to be beyond the reach of the law, with something akin to diplomatic immunity.

        It’ll be interesting to see how those kids in the cages-the ones without parents now, because of US “policy”-turn out. The ones we’re depriving of care, education, and real homes. Pretty sure I’d hold a grudge about that.

        Wouldn’t he draft the EO more narrowly to make not “subject to the jurdisdiction” of the US only for the purposes of the 14th amendment. This whole thing is a nightmare.

        Seems pretty implausible. But if it gets beyond a shameless political stunt & they try to actually execute it, it’s not going to come down to who has a defensible legal argument - it’s going to come down to what Trump’s SCOTUS picks want to do. Then we all get to revolt!

        The argument (which is bunk) is that the 14th Amendment was specifically meant to overturn Dred Scott, and that based on its legislative history (which conservatives supposedly don't rely on) that phrase in that context ALSO means "born of parents lawfully in the country."
