Technically, isn’t YouTube in violoation of that contract, since you and Audible both had good faith reasons to believe YouTube would never put ads on this video per their own policies regarding sponsored content? Might be time to get your sponsor involved...

It just doesn't make sense to get mad at people for following the letter of the law. It is the media companies abusing the DMCA system not youtube. The only other option for Youtube is to take personal responsibility for other peoples use or missuse of copyright.

YouTube said that they wouldn't put ads on sponsored content, and in the metadata it clearly says the video was sponsored contact, therefore the ad shouldn't be there in the first place. How are they not breaking their own contract? How can you claim they are not responsible?
