In the modern case I believe it's the inner party / outer party dynamic. One of the bones the Party of Permanent Revolution would toss to the Catholic analogues was quid pro quo on the whole prosecution thing.
Caesar started it by abusing his senatorial(?) privilege of immunity to prosecution while in power. It's not like his opponents were edgelording and he replied in kind. He obviously planned to break the law on day 1.
