I don't think that hurts his chances too much, especially since he's a background element that doesn't effect gameplay, much like Toon Link on the Spirit Train stage.
I feel they could just remove him from said background were he to become a character, since we already have Silver and maybe Knuckles, if his AST isn't in play.
Only thing is- Knuckles actually still appears too

This doesn't deconfirm Tails's chance at joining as a playable fighter. They can just remove him when Tails in on that stage. Just like what happens when Toon Link is being played on the Spirit tracks stage. He still has a chance
