There’s no reason they couldn’t be. It’s up to the courts to decide.

Hi Brian. If you listen to the podcast, you will learn that Congress passed a law in the 1990s that effectively bars victims from suing gunmakers and sellers. Many states have similar laws. So it's really not up to the courts.
