One of the advantages of birthright citizenship is that the children of people born here do not grow up with fewer legal rights than the children of citizens. Thus, the government does not legally limit assimilation to American norms as happens in Europe.

I’m not a fan of Harris, but does anyone think she would be just as American or successful if she grew up in a US black market? Of course not, but that’s what following Eastman’s interpretation of the 14th amendment would produce - times tens of millions.

Restrictionists can think of the citizenship clause of the 14th amendment as solidarity insurance. If immigration laws are not perfectly enforced (stop laughing, it’s a hypothetical), then at least their children will assimilate. A huge & unintentional benefit.

Birth right citizenship isn’t the only reason immigrants & their kids assimilate well here (we’re not a nation state, so non blood-based identity also helps), but it is a contributing factor.

Eastman is only correct if the Dred Scott decision is still valid. His appeal to what the Founders believed is a declaration that Blacks (and only Blacks) cannot be citizens, because common law natural born citizenship applied to all others since the Revolution.
