      Has hiring women and minorities offset the cost of non woman non minority misconduct? I'm sure the answer is no, but a better solution would be putting the costs directly onto the bad actors.

      who would be held responsible in the case of the nascar noose that was just a garage pull? i'm not in favor of abuse, but when i bartended in a fast paced stressful environment, anybody could yell at anyone except men couldn't yell at women. asymmetrical.

      The nature of the justice system is always going to be noisy. I still doubt that the majority of cases where a guilty verdict is found are as baseless as in your examples. Overall costs may still create unwanted incentives and disincentives though

      the thrust of my OP is that if i started a biz today, i have had a preference for straight white men beaten into me despite my natural egalitarianism. i'd have a duty to my family and the families of my employees, why risk hiring someone with societal support for grievance?

      this goes beyond litigation too. i can tell two white men to shut the fuck up. i can tell a straight white man how to dress, how to wear his hair, how to speak to clients and coworkers. it's sad, and it's a small percentage of other groups ofc, but where does my duty lie?
