Human behavior exhibits ethical assumptions which most clearly believe, but of which many are unaware. Repeatedly acting them out non-verbally without spelling them out verbally shows they're real but unconscious. A legal system discovers and articulates this common natural law.
I should hope not, it's pretty much pointless in that case.
