There should be a specific legislative definition for such an action e.g. 'serious health injury that led to fetus death'. If the law considers fetus a person a subject of law then it's a murder. As well as an abortion. Otherwise no, it's an injury to health.

There should be a separate crime for killing a fetus due to malice or gross negligence when the action is not a result of self-defense. But, not murder.
