if insider trading was legal there would barely be any outsider trading, which would ultimately mean barely any trading at all making it much harder for companies to raise money by selling equity - the whole system would grind to a halt

if you tried to legalize it, companies would just have set their own restrictions to prevent it so that outsiders would be willing to invest in them. so it makes a lot more sense to just outlaw it centrally, for the sake of the companies themselves

Wrong question. It pre supposes the existence of the casino-like system of the stock market, then asks if cheating should be legal. Let’s abolish the casino.

I don't know how to regulate it but it can't be stopped so may as well allow it but try to limit the damage
