i guess wether they can or can’t isn’t the question, rather it is to prevent it entirely by saying they can’t (deterring people that would take advantage) because we don’t believe their judgment is strong enough to make the right choices.

The prefrontal cortex isn't developed until about 18 years of age. This part of the brain is responsible for rational decision making, especially in the heat of the moment. It's also the first part of the brain to be inhibited by alcohol. Legal consent is iffy without it.
