Agreed, but unregulated they would write contracts with exceptions that give them all of the power and benefit. "Must Cover" "Can't exclude" maximum overhead, assets reserves to cover risks, etc all have a place. The existing regulations mostly came from abuses by insurers

It used to be that insurance companies would not cover housing in minority neighborhoods, where redlining forced people to buy, or charged super high rates to these captive customers. This is one example of abuse, there are many more like that.

My general stance with unions is that they are good in concept, but they have a tendency to concentrate power when they are voluntary rather than help the powerless. BART employees can have a union, Walmart day employees have a tougher time.
