It should only be allowed with that person's permission.
You should never be allowed to use someone's image without their permission or knowledge to sell something.

this seems like something that someone should be able to specify in their will
we can now use dead people's images and voice to create new media - this seems like a profound opportunity

I'm surprised that "not allowed" is winning. Yes it's tacky, but so long as rights are held by the estate, what justifies banning this?

I think the law would see it as an image of the celebrity, and the answer would hinge on who “owns” the celebrity’s image.

I'm for it, if only because it's a major double-edged sword (then again, bad publicity != bad when it comes to marketing...). But the bigger question is: what about long-term "missing" celebrities who might be presumed to be dead?
