It should be a separate category of crime of killing someone else's fetus.
If that is homicide, then a raped woman getting an abortion also should be changed with murder.
That would be an absurdity in pragmatical sense.

Not homicide. But assault/battery or whatever other charges come with a powerful and potentially lethal strike.

Grievous assault causing gross bodily harm or something along those lines. It's up there but still assault.

There's a technical error in this post; miscarriage is defined as a pregnancy ending before the fetus is viable. Typically the cutoff is 20 weeks. Definitionally anything "late term" would be a stillbirth.
