I'm actually on favour of metal detecting in ROI and hence for a change in the law. A total ban and imposition of a jail term are totally over the top. A decent middle ground where the hobby is regulated seems much more sensible.

...as an American, I don't understand why this is a big deal (serious, not snarky). Folks go up and down the beaches here with metal detectors all the time; it's a harmless pastime. Could someone sum up why it's illegal there? (Even on your own land?)

Metal objects on beaches are (mostly) not in archaeological contexts. They're akin to stray finds. Metal objects on land - especially older objects - are usually within secure archaeological contexts. Digging them out destroys that context.
