The GOP senators can still take some steps to try to ameliorate the situation & provide a rationale that would justify such a truncated "trial" & that they are willing to take to the voters. Their constituents will pass the ultimate judgment on this process. 5/6

Amazing pictures of the world's largest vertical filing cabinet. and : thank you for saving us from this fate. (Though I kind of like the movable workstations.)

On the positive side, it's good and important that several Republican senators are asserting narrow or prudential reasons for planned votes against conviction, rather than accepting the sweeping claims of the WH which would enfeeble Congress.

Perfect example of the corrosive effects of the Trump administration's foreign-policy dishonesty: how can we be sure this is primarily to stop coronovirus spread and how much because Trump doesn't like China? Unthinkable question with any other administration.

Trump may believe that he is the state and that anything that’s good for him is good for the country. But this just shows that he was never equipped to swear the oath of office.

Despite his walkback, Alan Dershowitz has presented arguments for Trump's acquittal that are outright authoritarian. And the president's defense team hasn't rejected them. In w/ :

but an acquittal that can be spun (by posterity) as based on doubts about the facts will be less bad that one in which half the Senate gives its official stamp of approval to the President's conduct. It's all bad, but maybe all that can be done now limit the damage?

...I wonder if calling witnesses and forcing Trump's team to respond will only make the inevitable acquittal an even stronger validation of this dangerous legal theory. Any acquittal will do damage to the Constitution and the separation of powers...

In an ideal world, senators would do their jobs and call relevant witnesses. But given that (1) acquittal is guaranteed, and (2) Trump's team has been making increasingly dangerous legal arguments that anything the President does is in the national interest...

An analytic mistake I am seeing is the assumption that the category of impeachable offenses is the set of things over which a president should be impeached. Impeachment is political in part b/c the difference b/w these sets calls for qualitative rather than categorical thinking.

We spend a lot of time looking at China to see the future of surveillance. But more relevant examples (at least for the U.S.) are other liberal democracies. E.g., the UK's embrace of real-time facial recognition.

Really interesting NYT piece on Clearview AI's facial recognition software. Particularly notable is a memo written by Paul Clement to convince law enforcement that using the software is legal (mostly third-party doctrine). Preview of arguments to come.
