Typically the reason defendants don't testify is to prevent the jury from knowing their prior felony record - most states would allow the state to impeach a defendant based on a prior felony conviction and allow a jury to ignore everything the defendant testified to.

I can assume that lately, it is a foregone conclusion that the accused would be found guilty unless they actually tell their side of the story….

It only help the defendant if the JUDGE is biased toward the person instead of against him.

Let’s hope so. It seems to lead to more convictions. Rottenhouse is the only of those high profile cases that ended in acquittal.

When our judicial system is set up to allow certain individuals off the hook with lesser or no charges, they are emboldened and take advantage.

It makes sense. If you plead not guilty, you should have no issue explaining why. Unless of course you know you’re guilty.
