This story goes back and forth between language suggesting he worked for the US directly and language that he worked for a project funded by the US. Those are not the same. Feel badly for him and his kids, but not seeing any merit or basis for his lawsuit. Seems misguided.

He was on a business trip in San Diego when, after his family back in Afghanistan received death threats, he opted to stay in the US and left them to fend for themselves in Afghanistan. Heartbreaking story, yes, but tweet is misleading. Most people don’t read the article.

Feel bad for his kids, but c'mon. The dad was already in the US for 2 yrs under asylum. The Trump-Taliban deal was brokered Feb '20 with a stated withdrawal date of May '21. Despite this, the dad waited until the last minute (Feb '21) to apply his sons for SIVs.pic.twitter.com/6fyTDjhGyO

It doesn’t actually say he was granted asylum, just that he was going to try for it. In the end he was granted special immigrant visa (different status) and filed for his sons the next month. He wouldn’t have been able to file for them prior to being granted status.
