        Wow. I had no idea commanders and not JAGs had discretion to prosecute. Makes zero sense. If a civilian woman was raped in her office, and the boss reviewed the allegation and got to decide whether the County prosecuted, of course solid cases would not be referred to prosecutors.

        JAG will make recommendations to the commander. 9/10 it’s NJP or less and automatic admin discharge. If JAG disagrees with the CCs assessment it can go to the next level CC and over rule or concur with the punishment. But yes…. To me it’s a JAG cop-out in reality
