It's protected but there are consequences. I'm not suprised they don't know there are consequences behind that said First Amendment.

Wrong. Their argument would hold water IF they were actually "press". They have plead in court before that they are entertainment, not news, and have no expectation to attempt to tell the truth. By doing so they left themselves wide open for this. They're not "Press"
