This is the 9th circuit - nothing else needs to be said. The path is now open to SCOTUS. Obama acknowledged DACA was unconstitutional from the start, Trump simply terminated an unlawful executive order. This is a no brainier for SCOTUS.

I'm sure you can supply a reference. The headline on the link also makes this claim but nowhere is there an actual quote.https://www.heritage.org/immigration/commentary/daca-unconstitutional-obama-admitted …
-
Just Google "Obama admits DACA unconstitutional", there are multiple You Tube videos where he himself states he did not have the authority to change immigration law (i.e. DACA).
-
If you make a claim, it's on you to back it up. You can't say "just Google it" for YouTube videos. Videos about what? What is your position on terminating 14A by executive order as Trump wants to do?
-
POTUS is pushing the 14th Amendment birthright issue into courts. There have been previous rulings that conflict with the notion that children born in the US to ILLEGAL immigrants are citizens. Many legal scholars believe they are not, and will press the issue before the courts.
-
Nope. Trump clearly stated that he can abolish it on his own. Paul Ryan made a statement that he cannot repeal it with EO. And what are the courts gonna do with repealing 14A? Courts don't make laws. They cannot repeal an amendment either, only congress can.
-
The courts, ultimately SCOTUS, interpret the Constitution. They determine what rights the Constitution imparts and what rights it does not. If they say the 14th does not grant birthright to illegal immigrants, then that is the law of the land.

lol... and try to keep that sense of humor when SCOTUS rolls the Obama's DACA order up and lights it on fire. Lower court rulings that Trump is not being very nice is not a justification to ignore the law. Immigration advocates have badly misjudged how this will end.

Will this rejuvenate the declining Caucasian birth rate?

Never underestimate how important Trump's victory and subsequent appointment of the SCOTUS justices is (not to mention the greater ease with which he can now appoint future ones thanks to his Senate victory Tuesday). The SCOTUS will rule on this.

McConnell changed the rules so Republicans could nominate activist Supreme Court Judges.
