2/ In other words, the time lag means that economic rents work for the actors that get them, whether slowing economic growth or stimulating innovation. (slow growth is not the opposite of innovation)

You're not even engaging the thesis. You said that patents actually slow capital down. Let's make a wager for the souls of all mankind; we will abolish patents. If you are right capitalism will accelerate. If I am right it will stagnate.

Patents are just one possible formulation of conceptual property, which are sand in the gears of Capital. Look at the route around of companies like Samsung, who engage in patent warfare i.e. take out patents on everything but generally only enforce / litigate reciprocally.

Yes well everything the state does may have a private technologically administrated replacement, but you needed the state to get that far to begin with.
