Patents are just one possible formulation of conceptual property, which are sand in the gears of Capital. Look at the route around of companies like Samsung, who engage in patent warfare i.e. take out patents on everything but generally only enforce / litigate reciprocally.

Didn't you just say that economic growth and innovation are not the same thing? IP likely promotes development in the sense of a proliferation of often redundant and ephemeral technologies, but what really matters is the efficient accumulation of capital.
