I'm surprised Justice Barrett ruled since she would normally recuse from this if it were a cert petition, given that she wrote for a panel majority on this case at 7CA at an earlier phase.

Technically this was a separate case (both in Dct and CA7) from the one where she wrote the CA7 opinion. She did recuse from the cert decision in that earlier case.
