With respect, how is this not a clear conflict of interest? This is like the a Union Leader also being CFO, who leads contract negotiations with the union. How does the 1st play in? The right to hold or run for public office has not as yet been expressly declared by the court.
1. The town council isn't involved on any level when it comes to school employee contract negotiations. 2. Lots of things can lead to conflict of interest when it comes to local govt, so there is a law governing what to do in those cases. (cont'd)

3. Maine law explicitly contemplates that public teachers can & will serve as municipal officers (30-A M.R.S. § 2605(4)(A)) 4. Courts have consistently held that the 1st A protects right to campaign for (Magill v. Lynch) & serve in (Mancuso v. Taft) public office.

Yes, but they do have a great amount of control over how the municipal and school budgets are crafted. Back in 15' there was a major dispute between Counselors, and the School department of the way funds were handled. Events like this be a massive conflict. 1/2
