Nice thought, right up to the point you try to decipher their "Terms of Service" which has your approval buried in there somewhere.
Not to worry - this bill requires ISPs to provide "clear, conspicuous and nondeceptive notice at the point of sale" and express consent (opt-in) by the customer.
