Not all people get the chance to go to college, not all have parents with connections, not all have communities that build them up

Last I checked everyone has the same opportunity to get good grades, go to college, and find a career. The ACLU is just grasping at straws.

Patently false. Lack of funding of schools is lower in Black areas so they lack basics like books, technology, so it's not a level field

Why funding is lower in those schools. Because they didn't see a proper return on education and the "educated".

Because schools are funded by the taxpayer. In lower income areas there are less public dollars actually circulated. Which includes schools.
