Being a right created by treaty, it has equal standing to the US Constitution according to Article VI. It is not within the power of Congress to delegate the power to suspend asylum rights without withdrawing from the treaty.

I actually had an attorney in our office tell me the immigrants should be applying for asylum at US embassies in Mexico. I explained he was wrong and told him "You're a lawyer. Stop allowing people to tell you the law. Pull the statute - 8 USC 1158 - and read it yourself. Geesh.
