It was an executive branch memorandum. It was not passed in the House or the Senate.
@POTUS can do away with it as quickly as Obama put it in place. SCOTUS will overturn the 9th...again. - 2 more replies

DACA actually isnt constitutional because congress didnt pass it. It was an executive order and in this country we dont let the executive branch pass legislation on their own. You cant be for one president doing something and against the next doing similar things.

Only dumb to dummies who desperately want to believe the lie ACLU just tweeted. Obama himself said what he did with DACA wasn’t legal. Once again, SCOTUS has to resolve a legal issue that the lower courts should have dealt with lawfully, instead of ruling with their feelings...
-
No, it’s dumb on its face. Obama didn’t pass any legislation. He instituted a program where people it would be absurd to prosecute could voluntarily identify themselves and receive temporary waivers. It’s a sensible thing for an executive to do because it wastes fewer resources.
-
Nobody needs the ACLU to point out that “I’m calling this EO legislation and Congress passes legislation dur de dur de dur!” is invalid. It’s essentially saying “I don’t like this so it’s unconstitutional...” which is an emotional argument btw.

Again, the ACLU shows they are not lawyers but merely activist.

How is it constitutional? Does the executive branch determine immigration law or not? If an executive order created it. How come another cannot undo it? Would love to know.
-
14th amendment. Dreamers are now legal residents. Trump can easily stop new applicants, but he can't legally remove DACA status from people who already have it. He should have learned this from the first Muslim ban.
-
So how does the 14th amendmant protect dreamers exactly?
