No I know, that's the definition of asylum, I just want to know where these people are being prosecuted to where they can be allowed to seek asylum in the US, if they aren't, then they haven't a right to claim "asylum"

Entirely endorse! Moreover, intervening in a foreign country to prevent individuals for lawfully making lawful asylum applications is on shaky moral and legal grounds—to put it mildly.

The "rule of law" is important here. United States immigration officers also need to respect the rule of law by faithfully processing the asylum claims of those who make them, whether they claim asylum affirmatively or defensively.

Once the Asylum seeker steps foot on the ground of another nation such as Mexico they can't go to another border/country and ask for asylum as they are no longer in fear for their lives.
