They are ruling based on WV law on books. If there be decent folk in that state, it could be appealed higher. Just embarrassing.

It isn't the Court's place to reinterpret statute that legislative bodies have declined to modify. This is basic separation of powers stuff.

The purpose of courts is to interpret and impose judgements based on existing law. It isn't to serve as quasi-legislators based on feels.

If you don't like that loophole in WV law, then your remedy is clear: the legislative body.

How much easier to simply retire to the fainting couch and dismiss WV as backward imbreds without an ounce of compassion for non-straights.

How hard would it be to pass legislation in WV that extended hate crime application to non-straights? Better to retain the outrage?
