Second and third degrees are so-called "lesser" offenses that involve some sort of statutory rape, i.e. the victim was incapable of consent, but wasn't physically forced or physically incapacitated. First degree rape is the most grevious offense, involving force or young children

This is mostly used to determine how long a judge can sentence a defendant. Even third-degree rape has a possible sentence of 25 years, though, so it's a quite serious charge no matter how it's classified.
