The original constitution was defective and led to a bloody Civil War. As Thurgood Marshall put it, "[w]hile the Union survived the Civil War, the Constitution did not. In its place arose a new, more promising basis for justice and equality, the fourteenth amendment[.]"

It's easy to overlook just how transformative the Reconstruction Amendments were, especially since they did not alter the structure of the federal government (three branches, checks and balances, etc).

But the Reconstruction Amendments redefined the meaning of "We the People." The Fourteenth Amendment was a first step in transition America from a herrenvolk democracy into a real democracy. Redemption can be understood as a nullification of the Reconstruction constitution.
