I understand the debate. A woman who miscarried could potentially be *suspected* of having an abortion. (Not nice if you are grieving.) But I can't see any scenario where the criminal standard of proof would be met i.e. the woman induced the miscarriage beyond reasonable doubt.

It's a sticky wicket. There are some examples in this article of other ways it might happen. An argument could be made that abusing drugs to the point of killing a fetus is an actionable offense.
