I want to add a couple points to this op-ed that and I have in this morning’s NYT. The Q I want to address is what Bolton could do if he wanted to get his story out quickly, rather than just preen and drum up advance sales on Amazon. (1/7)

The prepublication review process that Bolton’s book is now going through is broken — and the government’s own documents show it. Worth reading this post from ⁦⁩ from last year.

Worth noting that agencies can, and often do, classify information retroactively as part of the prepub process. For a discussion of this, see this law review article:

The prepublication review system gives far too much power to government censors—power they frequently use to suppress speech that is inconvenient to them.

Multiple federal courts have held that the government has no legitimate interest in censoring unclassified information in the name of prepublication review. That's a fundamental principle, and if NSC is reviewing for exec privilege, it seems pretty clear they're violating it.

Trump has already said he would invoke executive privilege over Bolton's testimony if called by the Senate. Now, reports that NSC will review Bolton's transcript for executive privilege issues, likely in consultation with the WH counsel's office.

Here's the key concern with the government's "prepublication review" of 's forthcoming memoir: Bolton’s book is of pressing public concern, and yet whether it ever sees the light of day will be decided by the administration it implicates.

Federal judge issues temporary order to not deport a Northeastern student. CBP does anyway. Federal judge gives up on the case saying “I don’t think they’re going to listen to me.” I am at a total loss for words.
