  1. Questions on what the first motion contained to both standards and stream use classification. (4-3 and 4-4) LUNCH!
  2. Next they will consider if the Dec board meeting will have a hearing on the rules. Mr. McKlurkan moved, seconded, motion passes.
  3. Mr. Halcomb moves approval of rules. Seconded. No discussion. Motion carried.
  4. Property rights interests killed it. Board member concerned about unintended consequences to designation.
  5. Question raised about upstream users of outstanding national resources water. Conasauga river was the test case. It was not designated.
  6. Denton is asking for a public hearing at the Dec. 15 board meeting. Good idea!
  7. Lot's of antidegradation changes. Dana will have to look at those.
  8. The selenium recreational criteria will be higher than the fish tissue standard. That doesn't make sense.
  9. Added selenium criteria for recreation.
  10. TDEC is looking to lower the amount of selenium in the standard for acute criteria which is EPA's criteria.
  11. They will open the stream use regulations but mostly to correct typos.
  12. Greg Denton introduces the Triennial Review. This review looks at all of the water quality standards that industry must meet.
  13. Ms. Davis, Board member, asks for update on the Rarity properties. Yay!

  17. Bill says that the standard should be on fish tissue. We agree. Buy yourself a lottery ticket because we never agree with Bill!
  18. Bill is saying that mining in W. Virginia were unable to meet the selenium standards.
  19. Bill Penny is talking now. He is claiming that since the triennial review is going forward, he'll just wait. How generous.
