  1. Oswego officials rip Hoffman a new one http://acandidworld.com/200... #ny23 #tcot #p2
  2. .@Paceset9999 read the article. Conspiracy theories aren't responsible.
  3. .@Seraid @gromance @robertcparker @FloridaJayhawk @Paceset9999 Machine virus story is a non-starter. http://tinyurl.com/yaujkyr #ny23
  4. Machine tampering concerns in #NY23 are misplaced. http://tinyurl.com/yaujkyr #tcot #p2
  5. Hamdi, Hamdan, etc. And those are just the ones that went to SCOTUS or, in Parhat's case, almost did.
  6. Thanks to @mmfa for pointing out trying detainees in civilian courts is not novel: Parhat v. Gates, Boumediene v. Bush, Rasul v. Gates...
  7. RT @mmfa: Quick Fact: Doocy advances misleading claim that "an enemy combatant" has "never" been "tried in a civil court": http://bit.ly ...
  8. Hoffman's "unconcession" shows a bad understanding of election law, facts, and grammar, too http://tinyurl.com/yf29x4d #ny23 #tcot #p2
  9. Trying KSM will be overdue vindication of the constitution as a document with relevance in wartime. If i'm wrong... Apologies all around
  10. @LessThanItTakes that's why the ACLU is pissing me off lately. Saying "habeas for Bagram!!" isn't just legally wrong. It's stupid!
  11. @LessThanItTakes and if you're detained in a combat zone same deal. Brought stateside, including gitmo? Another issue...
  12. @LessThanItTakes and when you're "subject to" what is the problem. No judge in the world would stop you from shooting a soldier on the field
  13. @LessThanItTakes heavens no! :-)
  14. @LessThanItTakes I'm pretty sure Scalia's brain would audibly explode if someone argues habeas runs to all battlefields :-)
  15. @clarlune fact!
  16. @LessThanItTakes HAH! You beat me to it!! :) That's right... I share your concern with porting any 'ol battlefield detainee to the SDNY :)
  17. @LessThanItTakes If Bush hadn't brought him to Gitmo, in a failed dodge of habeas jurisdiction, he could be tried by commission. Cf. Bagram
  18. @LessThanItTakes problem with KSM is unique to Bush -- battlefield detainees aren't normally tried in US courts, but Bush brought him here
  19. @dmataconis That's purely academic. They wouldn't prosecute if they couldn't convict. Granted sometimes that goes awry but not at this level
  20. @clarlune YES! Love West Wing
